Terms & Conditions

1. Agreement

a) These Terms & Conditions apply to you as the customer and to your use of the Tk’s Furniture website, associated systems, networks, and processes, including the purchase of goods or services online, in-store, via phone, or through social media channels.

b) By browsing our website or placing an order, you agree to be bound by these Terms & Conditions.

c) These Terms & Conditions apply to all customers of Tk’s Furniture, regardless of how an order is placed.

2. Interpretation

In these Terms & Conditions:

• Agreement means these Terms & Conditions and any terms included in an order.

• Customer means the individual or legal entity identified on the invoice or sales document.

• Delivery Cost means any delivery charges associated with an order.

• Goods / Products means items purchased from Tk’s Furniture.

• Pre-sale means items sold in anticipation of future stock availability.

• Website means the Tk’s Furniture website and related platforms.

• Intellectual Property includes all trademarks, logos, designs, images, content, and media used by Tk’s Furniture.

Words in the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.

3. Website Use

a) Our website may contain links to third-party websites. Tk’s Furniture is not responsible for the content, accuracy, or privacy practices of external sites.

b) You must ensure your use of the website complies with all applicable laws.

c) Tk’s Furniture is not responsible for damage caused by viruses, malware, or other harmful material resulting from use of the website.

4. Pricing

a) All prices are in Australian Dollars (AUD).

b) Prices include GST unless stated otherwise.

c) Prices may change without notice. Once an order is confirmed, pricing is locked and will not be adjusted retrospectively.

d) Delivery charges are calculated at checkout and confirmed with your order.

e) Free delivery offers apply only to eligible postcodes and remain at the discretion of Tk’s Furniture. Remote or non-standard locations may incur additional charges.

f) Tk’s Furniture reserves the right to refuse any sale.

g) Promotional codes must be applied at checkout and cannot be applied retrospectively.

5. Product Information

a) Product specifications, images, and features are subject to change without notice.

b) Dimensions and weights are approximate and based on fully assembled items.

c) Product imagery and videos may represent a product range and not an exact item.

6. Orders

a) By placing an order, you make an offer to purchase goods under these Terms & Conditions.

b) Orders are confirmed once Tk’s Furniture issues an order confirmation.

c) Tk’s Furniture primarily communicates via email. Customers must ensure correct contact details are provided.

d) Each confirmed order constitutes a separate agreement.

e) Tk’s Furniture does not apply retrospective discounts.

f) Tk’s Furniture reserves the right to cancel or refuse orders for commercial quantities.

g) Change-of-mind cancellations are not accepted. Where a cancellation is approved at our discretion, a 20% cancellation fee per item (including delivery) will apply.

h) Cancellations made within 48 hours of a scheduled delivery may incur an additional $100 handling and re-warehousing fee.

i) Refunds for cancelled orders will be processed less applicable fees or may be issued as store credit where agreed.

j) Product specifications may be altered in the interest of improvement and do not entitle cancellation or refund.

k) Tk’s Furniture is not responsible for orders affected by internet or system failures.

l) Stock will not be held longer than 8 weeks unless agreed. Storage fees of $80 per week may apply.

m) Future order / container allocation items require a minimum 50% deposit and full payment within stated timeframes.

7. Payment

a) Accepted payment methods include major credit cards, Afterpay, Zip, PayPal, Latitude, and other approved finance providers.

b) Payment is processed immediately upon order confirmation, including pre-sale items.

c) Tk’s Furniture may request verification for suspicious transactions.

d) Orders will not be dispatched without full payment received at least 3 business days prior to delivery.

e) Finance arrangements are the responsibility of the customer. Tk’s Furniture is not liable for issues arising from third-party finance providers.

8. Delivery & Ownership

a) Delivery dates are estimates only and delays may occur.

b) Goods are not delivered to PO Box addresses.

c) Title and risk pass to the customer upon delivery acceptance.

d) Authority to leave goods voids delivery insurance.

e) Tk’s Furniture is not responsible for delays once goods are dispatched.

f) Incorrect delivery details may result in additional charges.

g) Collection or third-party courier use transfers responsibility to the customer once goods leave our premises.

9. Delivery Conditions

a) All goods will be delivered to the front door only of your nominated address. For apartments or unit blocks, delivery will be made to the ground floor foyer. Internal placement of goods is at the driver’s discretion.

b) Safe and suitable access for delivery vehicles is required.

c) Deliveries are conducted by a single person. For bulky items such as lounge suites, you may be asked to assist the driver with lifting.

d) Delivery guarantees are subject to operational and external factors.

10. Faulty or Damaged Goods

a) Goods are assessed in accordance with Australian Consumer Law.

b) Visible or transit-related defects must be reported within 7 days of delivery.

c) Tk’s Furniture may repair, replace, or refund at its discretion where applicable.

d) Photographic evidence may be required.

e) Misuse, neglect, or general wear and tear is not covered.

f) Mattress warranties require the use of a mattress protector for it's entire lift before making any claim's due to health and hygiene reasons. 

11. Refunds & Returns

a) No refunds or returns for change of mind or incorrect purchases.

b) Returns must follow instructions provided by Tk’s Furniture.

c) Items must be returned in original condition.

d) Cleaning or damage fees up to $500 may apply.

e) Mattresses and linen are non-returnable except as required under Australian Consumer Law.

f) Custom or made-to-order items are non-refundable.

12. Warranty

a) Products include a 12-month standard warranty unless stated otherwise.

b) Warranties do not apply to commercial purchases or clearance / as-is items.

c) Consumer guarantees under Australian Consumer Law apply and cannot be excluded.

13. Intellectual Property

All intellectual property remains the property of Tk’s Furniture and may not be reproduced without permission.

14. Indemnity

You indemnify Tk’s Furniture against claims arising from misuse of our website or products.

15. Limitation of Liability

To the extent permitted by law, Tk’s Furniture is not liable for indirect or consequential loss.

16. Privacy

Tk’s Furniture collects and uses personal information in accordance with the Privacy Act 1988. Information is used for order fulfilment, marketing, repairs, and business operations.

17. Security

We take reasonable steps to protect customer information using SSL encryption, firewalls, and secure systems.

18. General

a) These Terms & Conditions may be updated without notice.

b) Invalid provisions do not affect the remainder of the agreement.

c) Failure to enforce a right does not constitute waiver.

d) Tk’s Furniture maintains a zero-tolerance policy for abusive, threatening, or aggressive behaviour. Staff are empowered to terminate communication, refuse service, cancel deliveries, or request removal from premises to ensure safety.
